Il TAR per la Lombardia e la sospensione dell\’art. 1 lettera H dell\’Ordinanza di Regione Lombardia 528/2020.

Sta facendo molto discutere il Decreto emesso dal TAR per la Lombardia in data 23.04.2020 avente ad oggetto la sospensione dell\’art. 1 punto 1.2 lettera H dell\’Ordinanza Regionale della Lombardia 528/2020.

 

Il provvedimento nasce da un ricorso proposto da Cgil Lombardia, Uil Lombardia, Filt Cgil Lombardia, Fit Cisl Lombardia, Uil trasporti Lombardia contro Regione Lombardia e la Presidenza del Consiglio dei Ministri per l\’annullamento previa sospensione dell\’efficacia, – dell\’Ordinanza Regione Lombardia n.528 dell\’11.4.2020, recante per oggetto “ulteriori misure per la prevenzione e gestione emergenze epidemiologiche da Covid 19\” nella parte in cui prevede che “E’ consentita la consegna a domicilio da parte degli operatori commerciali al dettaglio per tutte le categorie merceologiche, anche se non comprese nell\’allegato 1 del D.P.C.M. del 10 aprile 2020\”.

 

Secondo i sindacati le ordinanze di Regione Lombardia avevano nei fatti \”deregolamentato e reso libere in contrasto con i Decreti del Governo con i quali si sono limitate una serie di attività produttive per contenere la diffusione del Virus.\” (Comunicato stampa congiunto del 23.04.2020 CIGL – CISL e UIL)

 

I Giudici amministrativi, avallando la tesi sostenuta dai sindacati, hanno accolto la richiesta di sospensione dell\’ordinanza regionale inaudita altera parte sulla base delle seguenti considerazioni: \”l’ordinanza, disattendendo i propositi enunciati e ponendosi in contrasto con la normativa emergenziale contenuta nel d.l. e nel DPCM citt., ha ampliato, anziché restringere, le attività consentite, autorizzando il commercio al dettaglio di tutte le merci, a fronte di un DPCM che limitava il commercio solo a precisate categorie merceologiche ritenute essenziali o strategiche; Ritenuta la sussistenza dei presupposti dell’estrema gravità e urgenza, incidendo la misura regionale sul diritto alla salute dei lavoratori rappresentati dalle organizzazioni sindacali ricorrenti; Considerato che il pregiudizio a diritti fondamentali presenti intensità tale da non consentire dilazione nemmeno sino alla data della prossima camera di consiglio utile, giustificando l’adozione di una misura interinale nelle more della definizione collegiale dell’incidente cautelare\”.

 

Le reazioni non sono mancate e non si sono fatte attendere.

 

Regione Lombardia ha immediatamente presentato istanza di revoca del decreto emesso dal TAR (fonte SOLE24ORE). La politica regionale, invece, si è divisa: la maggioranza ha difeso l\’operato della Regione e la minoranza ha invece parlato di risultato preannunciato.

 

Anche le associazioni di categoria dei commercianti, allarmate per una potenziale ulteriore limitazione alla propria attività, si sono fatte immediatamente sentire (si veda ex multis l\’interessante articolo apparso sull\’Eco di Bergamo il 24 aprile 2020), sostenendo l\’irrilevanza del decreto in quanto le consegne a domicilio \”restano consentite anche per i beni diversi da quelli alimentari, come chiarisce il ministero dell’Interno\”.

 

Insomma, chi ha ragione? Le attività non ricomprese nell\’allegato 1 del DPCM del 10 aprile 2020 e che quindi NON possono restare aperte al pubblico possono proseguire le vendite effettuando consegne a domicilio?

 

A parer di chi scrive la risposta è certamente positiva.

 

Se infatti è indubbio che il decreto del TAR abbiamo messo momentaneamente \”fuori uso\” l\’art. 1 punto 1.2 lett. H dell\’Ordinanza 528/2020 della Regione Lombardia, è altrettanto pacifico che, come previsto all\’art. 2 \”disposizioni finali\” della medesima ordinanza \”Resta salvo, per gli aspetti non diversamente disciplinati dalla presente Ordinanza, quanto previsto dalle misure adottate con il Decreto del Presidente del Consiglio dei ministri del 10 aprile 2020.\”

 

E cosa prevede in tal senso il DPCM del 10 aprile 2020?

 

Riportiamo pedissequamente quanto contenuto nelle F.A.Q. rinvenibili sul sito del Governo (qui) e, per quanto ovvio, aventi efficacia su tutto il territorio nazionale:

 

\”I negozi e gli altri esercizi di commercio al dettaglio che vendono prodotti diversi da quelli alimentari o di prima necessità e che quindi sono temporaneamente chiusi al pubblico, possono proseguire le vendite effettuando consegne a domicilio? Sì, è consentita la consegna dei prodotti a domicilio, nel rispetto dei requisiti igienico sanitari sia per il confezionamento che per il trasporto, ma con vendita a distanza senza riapertura del locale. Chi organizza le attività di consegna a domicilio – lo stesso esercente o una cd. piattaforma – deve evitare che al momento della consegna ci siano contatti personali a distanza inferiore a un metro (i prodotti di prima necessità sono elencati nell\’allegato 1 al Dpcm 10 aprile 2020). È altresì consentita la vendita di ogni genere merceologico se effettuata per mezzo di distributori automatici.\”

 

E ancora:

 

\”Ho un sito per la vendita di prodotti online. Posso continuare l’attività di vendita? Sì, l’attività di commercio di qualsiasi prodotto effettuata online ovvero mediante altri canali telematici è sempre consentita alla luce della disciplina per gli esercizi commerciali prevista dall\’allegato 1 del Dpcm 10 aprile 2020, nonché dell’inclusione dei codici Ateco dei servizi postali, vettori e corrieri tra quelli eccettuati dalla chiusura dell’attività.\”

 

In conclusione, è evidente che il provvedimento del 23.04.2020 del TAR per la Lombardia abbia una portata pressoché inconsistente. La parte dell\’Ordinanza Regionale oggetto di sospensione, altro non era infatti, che la mera trasposizione di quanto già previsto nel D.P.C.M. tuttora valido ed operante su tutto il territorio nazionale, ivi compresa la Lombardia.

 

Due provvedimenti diversi, ma dal contenuto identico. Quindi, sospesa una, si applica ancora l\’altra. Insomma, ci corre alla mente quanto diceva Tomasi di Lampedusa nel Gattopardo: tutto deve cambiare perché tutto resti come prima. E così è oggi in Lombardia. Esattamente uguale a prima del Decreto del TAR.
